Agreement on the basis these terms and conditions arise upon the fulfillment of all the following:
· a completed web booking form
· clearance of the payment
Fat Squirrel Outdoor Company Ltd reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no agreement arises and the Fat Squirrel Outdoor Company Ltd will return any payment accompanying the booking.
The agreement is between the Fat Squirrel Outdoor Company Ltd and the client(s) and is the sole agreement between the two parties. No variation of these terms and conditions shall be applicable unless agreed in writing by the Fat Squirrel Outdoor Company Ltd at the time of the booking.
The agreement is governed by English Law.
Fat Squirrel Outdoor Company Ltd reserve the right to update its Terms & Conditions at any time, without notice to client(s).
Tickets for events, activities, parties and group bookings must be purchased in advance via the website. We do not accept entry on the day without prior arrangement.
There is a specified maximum number of people for each type of activity. If you wish to add more people to your booking please let us know in advance, we reserve the right to refuse entry to manage the number of people in the woodland at any one time.
If you need to change a booking please email us hello@fatsquirreloutdoor.co.uk and we will do our best to offer you an alternative date. If you need to cancel we will refund the fee you paid minus 20%, as we have to pay fees to process refunds. Please note that we cannot accept cancellations within 72 hours of any booked or ticketed event because there is not enough time for us to resell the slot or tickets.
If Government advice requires that we cannot host your booked session then an alternative future date will be offered.
Whilst ever effort is made to limit prices to those given at the time of the booking and in writing, Fat Squirrel Outdoor Company Ltd reserves the right to alter prices should its costs in hosting an event of any kind increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport, materials and rent etc). In the event of the price being increased by 15% or more, the client(s) may opt to cancel the booking and then will be entitled to a refund of all monies paid.
Woodland activities by their very nature are exposed to natural variables, including the weather. Whilst every reasonable effort will be made to fulfill your booked session there may be occasions when the Fat Squirrel Outdoor Company Ltd, through no fault of its own, is forced to vary, modify or cancel booked sessions at short notice because of natural circumstances. The client (s) acknowledges that information about the activities provided by Fat Squirrel Outdoor Company Ltd is given in the best faith but because of the variability of nature and the weather, it may be reasonable to alter, modify or cancel a booked session and in such circumstances, it is not reasonable for Fat Squirrel Outdoor Company Ltd to be liable for any losses consequential on such a change. Therefore, the Fat Squirrel Outdoor Company Ltd liability is limited accordingly.
The client(s) acknowledges that persons attending Fat Squirrel Outdoor Company Ltd are entitled to expect a high standard of conduct and regard for personal well-being on the part of all client(s).
For this reason, the client(s) accepts that Fat Squirrel Outdoor Company Ltd may, in absolute discretion and without the need to give reasons, arrange for him/her to be removed from a booked session, if necessary, against his / her will. Circumstances in which this might occur include (without limitation) disorderly or abusive conduct, intoxication, failure of control over children, inadequacy of clothing or equipment, incapacity or inability to meet the rigours of the activity undertaken. In some circumstances the client(s) will not be entitled to a refund of monies and Fat Squirrel Outdoor Company Ltd will not be liable for any losses so resulting. The client(s) will on demand reimburse Fat Squirrel Outdoor Company Ltd its reasonable costs of affecting his/her removal.
The Fat Squirrel Outdoor Company Ltd activities and events take place in woodlands and open countryside and are by their very nature not free from hazard. Fat Squirrel Outdoor Company Ltd makes every effort to minimise risk to clients and instructs clients in the safe negotiation of such risk as may remain. Consequently, the client(s) acknowledges that there are circumstances in which an accident could befall a client without Fat Squirrel Outdoor Company Ltd being at fault and accepts that to that extent he/she is taking part in a course and / or party run by Fat Squirrel Outdoor Company Ltd at his / her own risk.
Fat Squirrel Outdoor Company Ltd only accepts liability for physical injury to a client(s) where it is shown to result from negligence on the part of the Fat Squirrel Outdoor Company Ltd.
The client(s) acknowledges that loss, damage and expense (including without limitation, loss of money, loss of damage to clothes and possessions, losses arising on the cancellation of a booking and the expense of delay and the harm caused other than negligence of Fat Squirrel Outdoor Company Ltd), however arising is not the responsibility of Fat Squirrel Outdoor Ltd and that the Fat Squirrel Outdoor Company Ltd liability is hereby limited.
The client(s) is solely responsible, where necessary, for ensuring that he / she has all necessary valid travel documents.
We welcome well behaved dogs, however aggressive or nervous dogs are not allowed on site at any time. An aggressive dog is defined as a dog posing a threat to humans or other dogs.
All dogs must be under the owner's control at all times, which means they must remain on a lead and held or securely tied at all times. Dogs must be on a lead when entering and exiting the woodland and owners/handlers may only bring the number of dogs into the woodland that they can adequately control.
Dog owners/handlers must keep their dogs in their view at all times and they must not be left unattended. Children under the age of 18 must be accompanied by an adult and should not be left in charge of a dog.
Owners/handlers are responsible for their dogs and any injuries and/or damages caused by their dogs.
Dog owners/handlers must immediately fill in any holes their dogs dig.
Chasing or running with the dogs on a lead is not all allowed.
The client(s) acknowledges that they must sign and complete a Consent Form for certain activities which must be returned to Fat Squirrel Outdoor Company Ltd at least 72 hours prior to the commencement of the clients booked activity or event. The client(s) will be reminded to complete and return the Consent Form(s). Failure to complete the Consent Form(s) by the client(s) could result in Fat Squirrel Outdoor Ltd having to cancel the activity and all cancellations terms and conditions as stated above will apply.
Although, as stipulated above, all Fat Squirrel Outdoor Company Ltd activity activities and events are taught by experienced, and capable instructors, it is not intended that any instruction provided to any client(s) whilst attending an activity or event will in any way qualify that /those client(s) to instruct a third party and no warranty is made to this effect. Fat Squirrel Outdoor Company Ltd hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any client(s) on the basis of having attended any Fat Squirrel Outdoor Company Ltd activity session, course and / or party.
In the unlikely event that the client has a cause for complaint about a Fat Squirrel Outdoor Company Ltd course and / or party, the complaint should be made to a representative of Fat Squirrel Outdoor Company Ltd during the session, in order that corrective action can, if necessary, be taken. The client(s) acknowledges that it is unreasonable to take no action during a course and / or party but to complain later. However, should a problem not be resolved, the complaint should be made in writing within 28 days from the close of the relevant activity session, course and / or party to the registered address or email of Fat Squirrel Outdoor Company Ltd.
